Case Study 2: Plain View, Open Fields, Abandonment, and Border Searches as They Relate to Search and Seizures

Officer Williams asked the neighborhood’s regular trash collector to put the content of the defendant’s garbage that was left on the curb in plastic bags and to turn over the bags to him at the end of the day. The trash collector did as the officer asked in order to not mix the garbage once he collected the defendant’s garbage. Then, Officer Williams’ partner, Officer Martinez, searched through the garbage and found items indicative of narcotics use. Officer Williams and Officer Martinez then recited the information that was obtained from the trash in an affidavit in support of a warrant to search the defendant’s home. Officer Martinez and Officer Williams encountered the defendant at the house later that day upon execution of the warrant. The officers found quantities of cocaine and heroin during the search and arrested the defendant on felony narcotics charges.

Write a 1- to 2-page paper in which you:

Identify the constitutional amendment that would govern Officer Williams’ and Officer Martinez’ actions.
Analyze the validity and constitutionality of the officers’ actions.
Assess if the officers’ actions were justified under the doctrines of plain view, abandonment, open fields, or border searches. Support your response by citing specific case law and/or contemporary cases.
Use at least three quality references. Note: Wikipedia and other similar websites do not qualify as academic resources.

Impact of Social Media, AI and Emerging Technologies on Intelligence Gathering This assignment observes emerging threats flowing from dependence on globally connected digital technology

U.S. President Thomas Jefferson once remarked, Laws and institutions must go hand in hand with the progress of the human mind.  As that becomes more developed, more enlightened, as new discoveries are made, new truths disclosed, and manners and opinions change with the change of circumstances, institutions must advance also, and keep pace with the times.

  ***

Consider these remarks in light of the dynamic influence of emerging digital technology.  Is U.S. Intelligence targeting, collecting and use, keeping pace with the times?

Please use a few relevant quotes from references/articles from online as well as the Naval Postgraduate Schools Center for Homeland Defense and Security and Homeland Security Digital Library

ethics in research

In this week’s lesson we saw the harm that researchers can cause their human subjects. Many of the examples that are used to highlight this harm come from the experimental method which is popular in the field of psychology. However, researchers who engage with human subjects can cause emotional harm simply by asking questions about issues like domestic abuse or reproductive rights. Survey respondents who provide information to researchers about their employer or their behavior at work may jeopardize their jobs. Given the IRB process that is in place we can have confidence that any scholarly research was conducted in an ethical manner. What are your thoughts on the two examples provided in this week’s lesson and why is it important to adhere to ethical norms in research?

Scenario: You are the commander of three shifts of corrections officers (COs) working around the clock in a maximum-security cellblock in a state penitentiary. You have an exceptionally good group of COs who have managed to intervene in most potentially violent problems without incident. They have developed an effective network of prison informants form the inmate population.

There is a Middle-Eastern man, about 65 years old, who is serving a life sentence for the honor killing of his own daughter. He has been in the prison for about 10 years. Your COs report to you that his mental state appears to be deteriorating. He is a moderately religious person and feels there is no reason for terror violence. Every time an article about terrorism or the threat of terrorism is published in the newspapers provided by the prison library, the inmate reports to the COs that there is a planned violent takeover by groups sympathetic to those terrorist causes related in the news. The Middle-Eastern terrorist sympathizers are incarcerated in the same cell block as the 65-year-old Middle-Eastern man. There are a number of American-born persons of Middle-Eastern descent incarcerated in the cellblock, and the inmate seems to have access to them as a sort of religious leader for prayer services and advice.

At first, you took him seriously, but when he started to explain who the extremists were and what their mission was, you began to realize that he was just selecting inmates in the cellblock and identifying them as potential inmates with violent intent. He would make up stories about the manufacture of makeshift weapons in the middle of the night. He would indicate that the Middle-Eastern terrorist sympathizers within the prison extremists had contacts with other organized inmates throughout the prison and a comprehensive riot and takeover of the prison was being planned. Several prison staff members working in the infirmary have been identified by the inmate as sympathetic to the extremists’ cause, and he has accused them of helping provide weapons and other materials.

Please respond to the following questions:

There are several types of disorders that may apply, please select one that you believe is appropriate and may be affecting this complainant. Why did you select that disorder?
What types of referrals are available for a mentally ill person of this sort?
How should you continue to handle this inmate’s reported intelligence information, and why?

the mixed approach

Why is it important to think about the research approach you plan on using for your papers? Most students just default to what they have always done. But what they have always done is typically only one of many different approaches. Please explain the Mixed Methods approach. Why do you think the approach has gained in popularity? Cite and discuss one advantage of the approach and one disadvantage of the approach.

Module/Week 6 — Environmental & Energy Policy

For each Discussion Board Forum assignment, you will interact in a free-flowing discussion of the biblical and constitutional parameters for the particular policy focus of the assigned module/week. These posts should be short and succinct (3-5 sentences at most per post) and should encourage greater interaction with your classmates. Thus, you are to post according to the following guidelines:

Biblical: One separate post (3-5 sentences) discussing Biblical principles such as natural law, inalienable rights, sphere sovereignty/covenant, the Sin/Crime distinction and the institutional separation of Church and State

Constitutional: one separate post (3-5 sentences) referencing the enumerated powers, Articles and Amendments from the Constitution which are relevant to the assigned policy area

There must be two separate posts. Both posts must focus on the general policy area for the assigned Module/Week. For instance, when the course module focuses on criminal justice, the Biblical post must focus on what the Bible says about what government may or may not do in fighting crime. Likewise, the Constitutional post must focus on what the Constitution says about what government may or may not do in fighting crime. Specific examples should be used and cited.

Feel free to interact with your classmates, but for grading purposes, you will only need the two posts mentioned above.

You must use the following sources:

1. the Bible,

2. relevant presentations and articles from Modules/Weeks 12 which focus on biblical and constitutional ideas, including the Biblical Principles of Government article,

3. the required reading from the assigned module/week, and

4. any additional relevant sources that you would like to use.
