First Amendment: Free Speech, Hate Speech, Threats

A 3-page, typed paper corresponding to the issues identified below is required each week throughout the semester. Papers must be typed (size 12 font) and double spaced with top, bottom, and side margins of at least one inch, and they must not exceed three pages. Papers are due at the beginning of the class period for which they have been assigned. Late papers and electronic submissions will not be accepted. Papers should be based exclusively on the assigned readings and your analysis of the corresponding issues; no additional research is expected. A fourth, blank page must be stapled to the 3-page paper. Approximately 10 minutes will be left at the end of each class period during which you will be asked to write on the blank page whether the thoughts expressed in your 3-page paper have been altered in any way as a result of the class discussion and explain why or why not that is the case. The 3-page papers will be graded based on: (1) how well they integrate relevant readings; (2) the substantive analysis provided, including use of relevant principles and facts; and (3) writing style. The thoughts expressed following class discussion on the attached blank page also will be considered in the assigned grade. Papers will be evaluated on a 10-point scale: 10-9=A; 8.5-8=B; 7.5-7=C; 6.5-6=D; 5.5 or below =F. The grade received on the weekly papers will represent 75% of the course grade.

Feb. 10  The First Amendment: The Freedom of Speech, Hate Speech, True Threats
Assume that just before Thanksgiving 2019, a snowfall blanketed the University of Olympus campus. Amanda Evans, an undergraduate student at the University, wrote Fuck Illegal lmmigrants in the snow on the podium in the center of campus by tracing 3-foot high letters with her hands. Numerous students saw the message before one person obliterated it by walking over it. Surveillance cameras had recorded Amanda as she created the message. The Universitys Community Rights and Responsibilities includes a Code of Conduct which all students are expected to obey; violations can result in a variety of sanctions including suspension or expulsion from the University. Among behavior prohibited by the Community Rights and Responsibilities is Disruptive Conduct, which is defined as:
Impairing, interfering with or obstructing the orderly conduct, processes and functions of the University or the community where the conduct occurs. This behavior includes, but is not limited to, excessive noise, abusive or obscene language in a public place, littering, obstructing vehicular or pedestrian traffic, and boisterous, indecent or threatening conduct which is unreasonable in the area, time or manner in which it occurs.
Following a hearing, Amanda was determined to have engaged in Disruptive Conduct and she was suspended from the University for one semester. She has appealed, arguing that the suspension violated her First Amendment rights. How should her appeal be decided, and why?

Corrections & Rehabilitation

Prepare and deliver a professional presentation based on the research paper you have been working on all session. Your presentation must be a minimum of 10 PowerPoint slides, excluding the cover and reference slides (with presenter notes on each slide).

Your supervisor was impressed with your research and has asked you to create a presentation to share what you learned with the department. There will be no oral presentation, so it is important that you provide sufficient detail in the presenter notes on each slide.

you need to use the first and the second one from this project to do this slide

Eyewitnesses, Interviews, and Interrogations Related to Psychopathology

Scenario: You are the senior member of a two-man hostage negotiation team for a maximum-security facility in the Northeast. You and partner are called to a cellblock where an inmate, identified as Alfredo Albondigas, has taken two facilities maintenance personnel and a fellow corrections officer hostage. He is claiming that there are aliens from another planet living in his cellblock and demanding that they leave immediately. He has given an ultimatum that if he does not see the flying saucer leaving the exercise yard area in 2 hours, he will kill the maintenance personnel that he has taken hostage because he knows that they are giving signals to the aliens about him and the other inmates.

Mr. Albondigas is armed with a handmade knife and has his head wrapped in aluminum foil. The Correctional Emergency Response Team (CERT) working with you has a green light to kill Mr. Albondigas, but there are no current opportunities presenting themselves. You have managed to get a throw phone into Mr. Albondigas and you have direct phone communication with him. Also, because of the phone’s design, when he hangs up, you can still hear what is going on in the room. He has not hurt the maintenance personnel so far, but he is using the corrections officer as a translator to speak to the maintenance personnel, as if the maintenance personnel were not speaking English, but some alien tongue.

This scenario may seem humorous because it is fictional, but if it were real, it would be very serious for both the hostages and Mr. Albondigas. You are tasked by the warden and incident commander to make an operations plan centered on dealing with this mentally ill offender.

Address the following questions in a 3 page position paper. Present this paper as if it were an operations plan to negotiate with Mr. Albondigas and end the hostage standoff. You do not need to plan the tactical response if the negotiations fail. The paper should confine itself to gathering the information that the negotiator needs and the approach to take when negotiating with Mr. Albondigas to end the standoff. Include the following:

Explain the mental state of the offender and the 2 most likely mental illnesses that are affecting him.
Explain what type of medical personnel you would like to have at the scene, and why.
Relate why you think, if the deadline is reached without a solution, Mr. Albondigas will or will not hurt the maintenance personnel. Explain your answer.
Articulate the persons whom you would like to have brought to the scene for interviews to help with information that you can use to talk to Mr. Albondigas.
Explain your approach as the negotiator when speaking with Mr. Albondigas, and why you would take that approach.

GBL ETHICS PROJECT

Most people do not spend much time thinking about the law, even though the law is all around them, all the time. As a society, we expect everyone to act in conformance with the law. Most people in society also expect people to act ethically. Note that for our purposes, unlawful behavior is generally also unethical.  But not all lawful behavior is ethical. There are many things individuals and companies may do that are in accordance with law, but that may well be considered by many to be unethical.  Unfortunately, we regularly and frequently see examples of unethical behavior in business.
The three primary purposes of this exercise are: 1) to encourage you to keep up with the world around you; and 2) to help you recognize just how much our society and your everyday life is regulated and controlled by law; and 3) to help you identify and reflect on some of the ethical challenges in society today.
Specifically, for this assignment, you are to find a news article reporting on a current event related to ethics in business or government.  Your primary article should be from a print media source such as the Wall Street Journal, Bloomberg, the New York Times, the Washington Post, TIME magazine, Newsweek, the London Times, the Guardian, or similar source. You may use information from NBC news, MSNBC, ABC news, CBS news, CNN, Fox news, NPR, PBS, the BBC, or other similar news source as one of your secondary sources. You need to be able to identify and differentiate good information from poor information on the Internet. You must provide attribution to any source of information you use in writing your essay.
Generally, blogs are not viewed as reputable sources of information. There are however some blogs that are very reputable, and could be used as secondary sources, e.g., Nate Silvers http://fivethirtyeight.com/ blog focuses on statistical analysis of election polls, sports, and other issues. Other places to look for reputable blogs can be University websites (in the U.S. they use .edu domains). Researchers often post summaries of recent papers on University website blogs. For example, Harvards School of Public Health has a fabulous blog where their researchers and professors write articles about their research (in language the average person can understand).
In addition to being cautious about relying on blogs for information, readers must also be acutely aware that many sites are now blending news content with advertising content. Such information is being called sponsored content or native advertising. Such content is generally, and very intentionally, written in the same style as the actual news content on the site but it is advertising and not unbiased news. Note that opinion pieces and editorials are not news articles. Also, please note that sites such as Wikipedia, Quora, ask.com, and other similar sites where the public answers questions or provides the input to the site may never be used for academic purposes.
Your essay must provide the title of the article and a link. You must summarize the article itself, and then provide an analysis of the ethical issues involved. You may include your opinion on the matter in the conclusion section. Please note that although you may add additional facts not found in the original article under the analysis section, that is not the primary purpose of the analysis section. You need to analyze the ethical issues under the analysis section. For example, describe who acted unethically, what was unethical, why was it unethical, who responded to the unethical behavior, who was hurt by the unethical behavior, etc.
Remember, just because something may be lawful does not mean it is ethical. Also, what you may view as unethical may well be viewed ethical by others.
Your essay must be formatted as follows:
1.    Do not use a title page.
2.    Use 8.5 x 11 inch paper.
3.    1 inch margins all around.
4.    Single spaced paragraphs with a 12 point space between paragraphs.
5.    Times New Roman at 12 point font.
6.    References are to be footnoted or endnoted. They may be in 10 point Times New Roman. Do not include a separate page for references.
7.    References are to be in Chicago format.
8.    The essay must be between 1.5 and 2 pages, including references. Do not exceed 2 pages.
9.    The essay must be between 700 1000 words, not including footnotes.
10.    You must use at least 2 references (the primary article and at least one additional reference).
11.    You must bring a copy of your essay to class on the due date. That copy must be printed 2-sided. No stapled, clipped or separate pages will be accepted.

he following discussion comes from your week 2 readings. Outside research to address these issues is encouraged. I would suggest using the online library for additional sources of information and research.  In addition, I would recommend utilizing the legal studies program guide.

At trial, a prosecutor must prove mens rea but does not have to prove motive in order to be successful in a prosecution. Unlike mens rea, motive is not an element of crimes. Mens rea and Actus rea are needed for a crime to be established.

Answer the following questions:

1) Distinguish the difference between mens rea and actus rea.

2) What role do you think motive should play in criminal cases? Explain your answer.

ANSWER THE QUESTIONS

3 part so answer

Part A Then Reply to Part B and C in your Option’s DONT FORGET THE CHRISTIANS VIEWS AND REFERENCE

PART A

Think about two environments you have experienced.
1.The first environment is one that did not confront the brutal facts, where the people (and the truth) were not heard.
2.Thesecond environment is one that did confront the brutal facts, wherepeople had a tremendous opportunity to be heard.

Whataccounts for the difference between the two environments? If you do not havethis life experience you are not off the hookyou will need to interview aleader who has these experiences and report on that. What does the contrastteach us about how to construct an environment where the truth is heard? Usingstrong Biblical support, explain how you relate this to your ChristianWorldview? Does your Christian Worldview help you develop this environment? Howdoes this relate to the ethical components of the Meese and Ortmeier text?

PART B
The two situations in which I have experienced these two environments exist among two different companies for which I have been employed. The first company, Company X, represents the first environment in which the brutal facts were not confronted, and the people or truth was not heard. The second company, Company A, represents the second environment in which the brutal facts were confronted, and the people or truth was heard.

Company X is a company that makes you feel like your opinion is welcomed, valued, and considered and that much needed changes will transpire soon however, after voicing your opinion repeatedly and seeing no changes, you realize this is simply not true.

Company A, on the other hand, does the same, makes you feel like your opinion is welcomed, valued, and considered but differs in the way that they are fluid and do make necessary changes for the better of the company, rather than refusing to budge based on pride.

The two companies may seem similar on the outside but on the inside, are two different environments altogether. When you can see that your opinion is valued and changes are being made to make for a better, more efficient workflow, you tend to develop positive feelings for a company that leads in that manner. An unwavering loyalty is built. There is a quote by Richard Branson that states, Clients do not come first. Employees come first. If you take care of your employees, they will take care of the clients and I believe that is true. If you take care of your employees, you will have employees who desire to work hard for you. A company that can do that will have grateful, trustworthy employees.

These behaviors correlate with the study of ethics, as well as values found within the Bible. Ethics plays a large part in all aspects of life which means that it also plays a part in business and organizational attitudes (Derr, 2012, p. 66). As Christians, we are always struggling to make the right choice in all aspects of our life, from personal to organizational. Making the ethical choice for most people means bowing to the overwhelming influence of peer pressure, avoiding punishment, or getting a reward (Plinio, 2009, p. 278). Especially avoiding peer pressure is pertinent in ethical decision-making. Trust and integrity are at the very core of any good and effective relationship (Meese & Ortmeier, 2001, p. 89). Without trust, any relationship will fail, personal or in business. The Bible states, Do to others as you would have them do to you (Luke 6:31, New International Version). Additionally, Kind words are good medicine, but deceitful words can really hurt (Proverbs 15:4, Common English Version).

PART C

When discussing two environments one where the brutal facts are hidden, and the truth is never heard and the second environment is one that confronts the brutal facts and gives people an opportunity to be heard and speak their truth. In the first environment where the truth is not heard can be an environment where it would be hard to make good decisions without knowing the truth about a certain situation. If people cling to a false reality it will mostly give them false hope and lead them down a path that will lead to their downfall. Especially if you put the first environment into a work setting such as an office or any workplace can lead to an unhealthy workplace where people put into leadership will not know what is going on in their company. These types of workplace environments can be caused by leaders who lead by fear and intimidation without allowing the people under them to express their opinions about the company and things they see wrong. All workplaces should be able to have an open dialogue throughout the hierarchy of the workplace this will lead to a healthy workplace culture and will help a business strive.

In the second environment where the truth is one that confronts the brutal facts instead of avoiding them is one where people will feel more open with expressing themselves and their opinions on certain topics. Even though the truth can be hard to hear sometimes it is important to always keep an open mind when it comes to other people opinions and truly evaluate them and give them strong consideration. Especially when it comes to being a leader it is always important to listen to the people under this will allow you as a leader to open a dialogue with your employees that is safe and makes them feel comfortable. Being able to hear the hard truth especially as a leader in an organization can help save you from making mistakes as a leader and also give you tips and information that could lead to growth for you company. As stated by Richard Bowman Adaptation capacity is a self-governing leadership disposition that characteristically leads to success (pg.2). Being able to hear the hard truth and change can lead to the company being more successful in the future.

From a Christian Worldview having an environment that confronts the brutal facts instead of avoiding them is very necessary. The truth is always leads to understanding even if it is hard to heard at first.  If we claim to have fellowship with him and yet walk in the darkness, we lie and do not live out the truth( 1 John 1:6). Not confront the truth only hurts the people that need to hear it the most and leads to either more lies or somebody being hindered in the process.
