Case Brief

Find four cases from your state that discuss the formation of the attorney-client relationship.  For each case, prepare a one-page legal brief as you learned to do in Legal Research and Writing I.  In case you need a quick reminder, a legal brief identifies and discusses:  Issue, Rule, Holding/Decision and Analysis/Reasoning of the case.  Each case must consider a different issue stemming from the attorney-client relationship.  Remember to use Bluebook format and citations.

Westlaw campus research is the database where students can conduct legal research and not a specific resource it would be like directing them to roadrunner to conduct a search.

Your assignment should demonstrate an understanding of legal writing, as well as the differences between legal writing and academic writing. It should demonstrate thoughtful consideration, a good understanding of the substantive content and demonstrate your ability to communicate information clearly, effectively and in an appropriate tone. Your response should reflect graduate-level writing and BLUEBOOK standards for formatting and citation. Be sure to adhere to Northcentral University’s Academic Integrity Policy.

The solo attorney you work for has a general practice. In this practice, this attorney has represented individuals in cases involving divorce, products liability, car accidents, wills, and criminal misdemeanors. .  You have just met with a potential client who has a medical malpractice case.  The attorney did assist on a medical malpractice case 15 year ago when interning with a law firm.  Seeing the possibility of a large reward, she asks you to conduct legal research to determine whether she can ethically represent the client.

Prepare a legal memorandum on the issue. Include your research and analysis. Your research should include at least five legal resources including, but not limited to, case law, statutes, rules, regulations and law journal articles.  Identify all ethical issues involved, possible solutions, and a final recommendation using the resources found in your research.

Length: 2-4 pages

Justice and Rights

In modern times, there is significant discussion about justice and rights. We often hear that something does or does not achieve justice or that someone has a right to something. Please address the following issues in your paper.
1.    Define justice and rights from a biblical perspective. This should set a standard by which claims to justice and rights can be analyzed.
2.    Select a specific, contemporary legal issue in the United States where individuals assert a right to something or state that something is inconsistent with standards of justice and apply a biblical understanding of justice and rights to conclude whether the specific asserted right or claim of injustice you selected is indeed a denial of a right or fails to achieve justice. Be sure to fully explain each part of your answer.
